Marketplaces ask for "manufacturer information" and sellers guess at what to enter. The regulation is specific about the fields, and about who the manufacturer is.
It is not only the factory. If a product is made for you and sold under your own name or trademark, you are the manufacturer for these purposes, with the Article 9 duties that follow, including the internal risk analysis and technical documentation.
Etsy's own guidance puts it the same way: its definition covers anyone who has a product manufactured under their name or trademark.
Own-brand sellers are the group most often surprised by this. Rebranding a supplier product makes you the manufacturer, not a distributor.
An importer adds its own name, registered trade name or trade mark and postal and electronic address, on the product, its packaging or an accompanying document, without covering the manufacturer's details (Article 11(3)). Importers also keep a copy of the technical documentation for 10 years.
Separately, the economic operator established in the EU must be identifiable: its name and contact details go on the product, packaging, parcel or an accompanying document (Article 16).
Article 19 requires online offers to show the manufacturer's name and postal and electronic address, the responsible person's details where the manufacturer is outside the EU, product identification including a picture and type, and any warnings or safety information.
Etsy collects this in its GPSR manufacturer and safety information section or as a shop-wide economic operator. Amazon collects it in its compliance area and shows it on product pages. The underlying content is the same.
Name, registered trade name or trademark, a postal address and an electronic address, plus a single contact point where different (Article 9(6)), along with a type, batch or serial number (Article 9(5)).
If it is sold under your own name or trademark, yes, you are treated as the manufacturer and carry those duties.
The regulation requires a postal address at which the manufacturer can be contacted; it does not create an exemption for sole traders. Many sellers use a business address service for this reason.
On the product where possible; otherwise on the packaging or in an accompanying document.
Instilus organises the documents you already have into a GPSR evidence pack. Take the free eligibility check.
