GPSR for US Sellers: Selling to EU Customers from the United States

Selling on Etsy, Amazon, eBay, Shopify or your own site to customers in the EU? The EU General Product Safety Regulation applies to those sales. Here is what it asks of a US business.

Does GPSR apply to a US seller?

The regulation has applied since 13 December 2024 and does not depend on where the seller is based. The US International Trade Administration puts it plainly: GPSR applies to all manufacturers who place products on the EU market, regardless of where the manufacturer is established.

For online sales, a product counts as made available in the EU if the offer is targeted at consumers in the EU (Article 4). Recital 21 lists the kind of factors weighed case by case: whether you ship to EU countries, the languages of your offer or ordering process, the payment methods and currencies you accept, and whether you use a domain registered in an EU country.

A website that EU customers can merely reach is not, on its own, enough. Actively selling and shipping to EU customers is.

You need an operator established in the EU

Article 16 says a product cannot be placed on the EU market unless an economic operator established in the EU is responsible for it. Under Article 4 of Regulation (EU) 2019/1020, that operator is, in order: an EU manufacturer; the importer, where the manufacturer is outside the EU; an authorised representative with a written mandate; or, only where none of those exists, an EU fulfilment service provider.

That operator makes sure the technical documentation can be given to authorities on request, cooperates with them, and informs them of risks. Its name, registered trade name or trademark, and postal and electronic address must appear on the product, its packaging, the parcel or an accompanying document.

What the US Government advises exporters

The International Trade Administration’s GPSR guidance advises US exporters to appoint an EU responsible person, prepare technical documentation proving product safety, provide warnings in the languages of the countries where they sell, make products traceable with batch numbers and manufacturer details, and be ready to act quickly on recalls.

Behind the label, Article 9 expects the manufacturer to carry out an internal risk analysis and keep technical documentation for 10 years. If you sell products under your own brand, that manufacturer is usually you.

Accidents involving serious harm must be notified through the EU Safety Business Gateway without undue delay (Article 20). Where the manufacturer is outside the EU, the EU responsible person must make sure that happens.
